255 characters limit in files and folders? If there is a limit, why Windows does allow it?

Sometimes i got an error in my File Server about the 255 chars limit of the file system.

That´s OK, we rename the folders and files and the problem goes away

But the end user always ask a clever question: If thre is a limit in the folder name, why Windows allow me to create files and folders with more than the limit to after the creation of the item, to block the access? To make sense, if the limit is there, why I can create beyond the limit?

Another issue: The coun of the 255 chars limit have to be considered on the folder where it is stored in the file server, the folder the user sees or both?

Example

In the file server the name of the file is on the edge is:

c:\data\shared\files\docs......\area\zone\filename.PDF (more than 256 chars)

But in the user view, the file is:

t:\files\docs......\area\zone\filename.PDF (less than 255 chars)

Where the limitation appears? I saw events where in the user perspective tha filename was below the 255 limit and inside the file sever was above the limit, but the user could not open the file
